These Terms of Service (“Terms”) govern your access to and use of viphoseandseals.com (the “Site”) and every purchase you make from VIP Hose and Seals (“we,” “us,” or “our”). By using the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.

2. Eligibility
You must be at least 18 years old and legally able to enter into contracts to use this Site. Many of the products we sell are industrial components intended for installation by trained personnel. By ordering, you represent that you are purchasing for a lawful business or professional purpose and that you or your installer are competent to select, install, and operate the products safely.
3. Products, Specifications, and Part Selection
We publish part numbers, dimensions, materials, pressure ratings, temperature ranges, and cross-reference data as supplied to us by manufacturers. That information is provided for identification and general reference only. Manufacturers change specifications, packaging, and construction without notice.
You are responsible for confirming that a part is correct and suitable for your application before ordering. A cross-reference match, an interchange number, or a dimensional similarity does not mean a part is approved, equivalent, or fit for your equipment. If you are unsure, contact us before you buy and we will help you verify, but final selection and suitability remain your responsibility.
We do not provide engineering, design, or hydraulic system consulting services. Nothing on the Site is engineering advice.
4. Pricing, Availability, and Errors
All prices are in U.S. dollars and are subject to change without notice. Inventory shown on the Site is not a guarantee of availability; stock levels move constantly and some items are drop-shipped or special-ordered from the manufacturer.
We make every effort to keep listings accurate, but typographical, pricing, description, image, and availability errors do occur. We reserve the right to correct any error, to refuse or cancel any order placed at an incorrect price, and to limit or cancel quantities, even after an order has been confirmed and payment has been taken. If we cancel an order for this reason, we will notify you and refund any amount already charged.
5. Orders and Acceptance
Your submission of an order is an offer to purchase. Our order confirmation email acknowledges receipt of that offer; it is not our acceptance. A binding contract is formed only when we ship the goods or, for custom work, when we begin fabrication. We may decline any order at our discretion, including for suspected fraud, resale restrictions, export restrictions, or pricing errors.
6. Payment
We accept payments processed through PayPal, including PayPal balance, PayPal Pay Later, and credit and debit cards entered directly on our checkout. In-person and phone transactions may be processed through Zettle by PayPal.
We never see, handle, or store your full card number. Card data is captured and stored by our payment processor in a PCI-compliant environment. If you choose to save a card for future use, our processor stores it and returns only a secure token plus the card brand and last four digits.
You confirm that you are authorized to use the payment method you submit, and that the billing information you provide is accurate.
7. Sales Tax
We are registered to collect sales tax in New Jersey and charge New Jersey sales tax on orders shipped to New Jersey addresses at the applicable rate. Orders shipped outside New Jersey are not charged sales tax by us; you may still owe use tax in your own state, and reporting it is your responsibility.
If you are purchasing for resale or are otherwise exempt, email a properly completed New Jersey exemption certificate to sales@viphoseandseals.com before placing your order. We cannot retroactively remove tax from a completed order.
8. Shipping Charges
8.1 Live carrier rates
Where every item in your cart has a verified shipping weight on file, our checkout displays live rates quoted directly by the carriers. Those rates are charged with your order.
8.2 “Best Way” shipping
Hose, fittings, and custom-built assemblies vary enormously in weight and dimensions, and many are cut or built to order. For carts containing these items we offer Best Way shipping. This is how it works, and by selecting it you expressly agree to it:
- Your order total at checkout covers the goods and any applicable sales tax. Shipping shows as to be determined and is not included.
- After your order is assembled and physically weighed, we determine the most economical practical service and calculate the actual freight cost.
- You authorize us to charge that shipping amount to the same payment method used for your order, as a separate charge, without further approval from you.
- You will receive a receipt for the shipping charge by email once it is processed. Your order ships after that charge is completed.
- If the freight cost is unusually high relative to the value of the goods, or if your payment method declines the supplemental charge, we will contact you before shipping and you may cancel for a full refund of the goods.
If you would rather approve the freight cost in advance, tell us in the order notes or email us right after ordering and we will quote you first.
8.3 International orders
International shipping is available on qualifying items. Quoted charges cover transportation only. Duties, import taxes, customs brokerage, and clearance fees are your responsibility and are collected by the carrier or customs authority, not by us. Refused or abandoned international shipments are not refundable for freight, duties, or return costs.
9. Delivery, Title, and Risk of Loss
Unless agreed otherwise in writing, all sales are FOB our facility in Paterson, New Jersey. Title and risk of loss pass to you when we tender the goods to the carrier. Transit times quoted by us or by a carrier are estimates only and are not guaranteed. We are not liable for carrier delays, weather, or events outside our control.
Inspect every shipment at delivery. Note visible damage on the carrier delivery receipt or bill of lading before signing, and report damage, shortages, or wrong items to us within 5 business days as set out in our Refund and Returns Policy.
10. Custom-Built Hose Assemblies and Cut Goods
Assemblies built to your specification, and any hose cut to a requested length, are made to order. Once fabrication begins these items cannot be cancelled, changed, returned, or refunded except where the assembly does not match the specification you supplied or contains a defect in our workmanship.
You are responsible for the accuracy of the specifications you give us, including hose type, inside diameter, overall length, end fittings, thread type, orientation, working pressure, and fluid compatibility. We build to the numbers you provide. Assemblies are proof-tested only where you request and pay for testing.
11. Returns, Refunds, and Warranty
Returns, restocking fees, non-returnable items, and warranty claims are governed by our Refund and Returns Policy, which is incorporated into these Terms by reference. Please read it before ordering.
12. Disclaimer of Warranties
Products carry the original manufacturer warranty. Hose assemblies we build are warranted against defects in our workmanship for 90 days from shipment, on the terms stated in our Refund and Returns Policy.
Except for those express warranties, all products and all content on this Site are provided “as is” and “as available.” To the fullest extent permitted by law we disclaim all other warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components, or that product data, cross-references, or availability shown on the Site are accurate or complete.
13. Safety and Proper Use
Hydraulic and pneumatic components store and release energy and can cause serious injury or death if misapplied. You agree that you and your personnel will: select components rated for the actual working and surge pressures of the system; observe minimum bend radius, temperature, and fluid compatibility limits; route and restrain hose to avoid abrasion, kinking, and twisting; relieve system pressure before service; never search for leaks by hand; and replace hose and seals at appropriate intervals. Never exceed a component published maximum working pressure. Follow the manufacturer instructions and all applicable safety standards.
14. Limitation of Liability
To the fullest extent permitted by law, our total liability arising out of or relating to any product, order, or use of this Site will not exceed the amount you actually paid us for the specific product giving rise to the claim.
We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, equipment downtime, loss of use, cost of substitute goods, labor to remove or reinstall product, environmental cleanup, third-party claims, or damage to equipment or property, however caused and on any theory of liability, even if we were advised of the possibility.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless VIP Hose and Seals and its owners, employees, and suppliers from any claim, loss, liability, damage, cost, or expense, including reasonable attorney fees, arising from your breach of these Terms, your selection or specification of a product, your installation, modification, or use of a product, or your resale of a product to a third party.
16. Resale and Export
If you resell our products you do so on your own account and may not represent yourself as our agent or as authorized to bind us. You agree to comply with all applicable U.S. export control and sanctions laws and not to export, re-export, or divert any product in violation of them.
17. Accounts
You may check out as a guest or create an account. If you create an account you are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at sales@viphoseandseals.com if you suspect unauthorized use. We may suspend or terminate an account that we reasonably believe is being used fraudulently or in breach of these Terms.
18. Acceptable Use
You may not use the Site to: violate any law; scrape, harvest, or bulk-download our catalog, pricing, or content by automated means; attempt to gain unauthorized access to any system; introduce malicious code; interfere with the operation of the Site; submit false orders or fraudulent payment information; or infringe anyone intellectual property or privacy rights.
19. Intellectual Property
The Site and its original text, layout, graphics, and compiled product data are our property or licensed to us and are protected by copyright and other laws. You may view and print pages for your own internal business use. You may not otherwise reproduce, republish, sell, or create derivative works from Site content without our written permission. Third-party brand names, part numbers, and trademarks appearing on the Site are the property of their respective owners and are used for identification only, as explained in our Legal Notice.
20. Third-Party Links and Services
The Site may link to third-party sites and relies on third-party services for payment, shipping rates, and email. We do not control those parties and are not responsible for their content, practices, or availability. Your use of a third-party service may be subject to that party own terms and privacy policy.
21. Electronic Communications
By placing an order or creating an account you consent to receive transactional communications from us electronically, including order confirmations, shipping and freight charge receipts, RMA correspondence, and account notices. Transactional messages are not marketing and cannot be unsubscribed while an order is open. Marketing email, if any, always includes an unsubscribe link. See our Privacy Policy for details.
22. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including supplier or manufacturer failure, freight carrier disruption, labor disputes, fire, flood, severe weather, utility or network outage, pandemic, act of war or terrorism, or governmental action.
23. Governing Law and Venue
These Terms and any sale made under them are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. You and we agree that the state and federal courts located in Passaic County, New Jersey have exclusive jurisdiction over any dispute, and you consent to personal jurisdiction and venue there.
24. Informal Resolution First
Before filing any claim, you agree to contact us at sales@viphoseandseals.com with a written description of the dispute and to give us 30 days to resolve it. Most issues, including wrong parts and freight disputes, are resolved quickly this way.
25. General
These Terms, together with our Refund and Returns Policy, Privacy Policy, and Legal Notice, are the entire agreement between us regarding the Site and your purchases, and supersede any prior understanding. Our failure to enforce a provision is not a waiver of it. If any provision is held unenforceable, the rest remains in effect. You may not assign your rights without our consent; we may assign ours in connection with a merger or sale of the business. Any purchase order terms, vendor agreements, or other documents you submit that conflict with these Terms are rejected and have no effect unless we accept them in a signed writing.
26. Changes to These Terms
We may update these Terms at any time by posting a revised version with a new effective date. Changes apply to orders placed after they are posted. Continued use of the Site after a change means you accept the revised Terms.
